On 9 June 2015, Aytaç Baran, the chairman of the New Ihya Association for Aid Assistance and Solidarity [Yeni İhya-Der], was massacred by PKK in Yenişehir province. The lawyer Abdulgani Orhan, who spoke to ILKHA on the occasion of the martyrdom anniversary, emphasized that the files formed in the course of the settlement should be handed in due to the persecution that the people of the region had been abandoned to the domination of PKK.

Orhan said that the other inquiry in Diyarbakır was open and ongoing regarding the murder of Aytaç Baran. He said that all applications were rejected with discourses such as “investigation is confidential, state is trustworthy, do not worry about state necessity.”

Orhan, stated that New Ihya Association Chair Aytaç Baran was murdered on June 9, 2015 in city of Diyarbakır while he was on the road going to his house.

“A secret hand was introduced”

After the assassination, Orhan stated that the investigation had begun in Diyarbakır, “But after the investigations, I believe that a secret hand entered. A policy for the favor of PKK has processed. And then Aytaç Baran file was taken to Kayseri for security reasons. The file was split into two parts. Just one person was arrested and another person was started to be tried in Kayseri in the name of Sezgin.”

Recalling that the Sezgin named person was later killed in a clash with the police in Diyarbakır, Orhan said in his speech:

“So there was only one defendant left in the file. The court did not make a serious judgment on whether that person was in the incident or not. That person was released from the murdering Aytaç Baran case lack of evidences. Other investigation in Diyarbakır related to the killing is still on and ongoing: all inquiries were rejected in the form of ‘we are confident in the investigation, do not worry about the state, do not worry, the state will do what is in need,’ for security reasons. When the file transferred to Kayseri and we went to there, I was seriously disappointed in the file.”

“The court did not properly conduct any investigation”

Orhan said that there were some images in the file reflecting the massacre of Aytaç Baran, “At least, there was footage that 2 persons follow Aytaç Baran from behind, pull the trigger and murder him. The court did not any straight examination on this footage.”

Orhan said, “In the file we were complaining about, Aytaç Baran came out from the association while the person is that person released in Kayseri, came from the other side, dropped the weapon in the way and took the weapon and wore the waist, then two other people walking after Aytaç. All these were identified and a presentation was made to the prosecutor's office. One of those 3 people was the person evicted in Kayseri, but the court acquit him.” (Emrah Deniz - ILKHA)
