Mustafa Ozan, detained while he was trying to break up a fight in the street in 1998 and tortured and punished on the plots, his Father Veli Ozan said that his son is in prison innocently for 18 years.

Father Ozan remarked that his son was detained during he newly got into university, and got paralyzed in consequence of tortures while he was under custody, emphasized that witnesses they brought weren’t listened by the court board.

Ozan said that his son sentenced to life time in prison unlawfully without any evidence, “My son we a student in high school and he was just got into university. He was going school and coming home. My son didn’t come to home on evening of 29 October 1998. I thought he hanged up in somewhere and will be late to home. I have been waiting till late but my son didn’t come home. We asked from relatives but we found no trace. I didn’t guess that my son took by police because my son was still a teenager. On the recommendation of a relative, I went to riot police headquarters. At the beginning they denied that my son is in there, with my urge they admitted that they took my son. My son stayed 12 days under custody and tortured” he said.

Prepared documents are signed by my son by force of torture

Ozan uttered that his son has experienced very heavy tortures, “My son was tortured until his body was paralyzed. Documents those prepared before by police officers are signed by my son by force of torture. According to my son he told me, police officers came to those are under custody and said ‘We will read and you will sign’. Those who hadn’t accepted the written in the papers were signed by the force of torture.”

We brought witnesses and requested to be listened but the court didn’t listen

Ozan said that after being under custody, his son was taken to the court and got arrested, Ozan continued his speech:

“The court process of my son continued more than 10 years. Each time the judge adjourned the court. In court, we objected the charged laid to my son. Even we brought witnesses to court to be listened but the court didn’t listen. After a long trial, the judge said that they want to end the case and adjusted the hearing to another day. The day that the judge adjusted the trial was Friday. The judge ridiculed us by saying ‘Friday is an auspicial day’. The day came and the hearing was seen. The court board took a break by looking at each other. After the break they announced the decision without taking us in to the court. They sentenced my son to life time in prison.”

Those who did this persecution to us are got in prisons

Ozan told that they have been victimized with the conveyance persecution within his son, “Families also victimized with those are in prisons. Our children have been expelled to far places. My son was referred once to Mardin, then to Diyarbakir, again from Diyarbakir to Mardin, then from Mardin to Erzurum and from Erzurum to Gaziantep. How they going to give to account for this victimization. There is no end for this persecution. And now who did this persecution to us are not got in jails” he said.

Those we experienced the authorities also will experience if they remain silent to this persecution

Ozan remarked that he sent letters many times to President and Prime Minister to explain their victimization, “My son has sent a letter to Abdullah Gul during the Presidential period. They answered that they are only dealing with the patient convicts. President and Prime Minister have visited Diyarbakir in May. I myself put a letter into the President’s pocket that explains the victimization we experienced but we didn’t get any answer. Now I call to President and Prime Minister again. They shouldn’t remain silent to this persecution. If they remain silent to this persecution, those we experienced also will happen to them. We don’t want forgiveness, they are victims who ask for forgiveness. We want from them to rehearing our children” expressions he used.

ECHR gave a ruling about Ozan that his hearing wasn’t fair and adjudged Turkiye to pay compensation

Adv. Mirhan Ozbekli stated that the European Court of Human Rights (ECHR) gave a ruling about Ozan that his trial wasn’t fair and adjudged Turkiye to pay compensation:

“The Supreme Court have to evaluate the individual apply about my client, that my client was being under heavy tortures and got cruel treatment, that there is no bond physically and legally of the event they associate with my client, and not listening of the witnesses which would effect on the result of court’s decision. The infringement decision of European Court of Human Rights is a bounding reason for my client to be rehearing again.” (ILKHA)
